Termination & Discharge Policy – Home for Elders
Home for Elders, we are committed to providing compassionate, high-quality care to all our residents. However, in certain situations, it may become necessary to terminate residency or discharge a resident due to specific circumstances. This Termination & Discharge Policy outlines the conditions, procedures, and rights of both the resident and our facility to ensure a fair and transparent process.
1. Reasons for Termination & Discharge
A resident may be discharged from our facility under the following conditions:
A. Voluntary Discharge
✔ A resident or their legal representative requests to leave the facility permanently.
✔ The resident has made alternative care arrangements (e.g., moving to a family home, another care facility, or independent living).
B. Medical & Health-Related Reasons
✔ The resident’s medical condition requires a higher level of care than our facility can provide (e.g., advanced medical needs requiring hospitalization or specialized nursing care).
✔ The resident has recovered significantly and no longer requires elder care services.
✔ The resident poses a serious risk to their own health or the well-being of others in the facility.
C. Behavioral & Safety Issues
✔ Repeated disruptive or aggressive behavior that threatens staff, other residents, or themselves, despite interventions.
✔ Non-compliance with facility policies, including violence, harassment, or abusive behavior toward staff or other residents.
D. Financial Non-Compliance
✔ Failure to pay fees or outstanding bills despite multiple notices and an agreed-upon payment plan.
✔ If the resident or their responsible party fails to comply with financial obligations stated in the contract.
E. Violation of Facility Rules & Regulations
✔ Repeated non-compliance with facility policies after warnings and attempts at resolution.
✔ Engaging in illegal activities within the facility, such as substance abuse or theft.
2. Notification & Process of Termination/Discharge
A. Advance Notice Requirement
✔ For voluntary discharge, the resident or their legal representative must provide a minimum of 30 days’ written notice to the administration.
✔ In cases where the facility initiates the discharge, a written notice will be issued at least 30 days in advance, except in emergencies.
B. Emergency Discharge
✔ If a resident poses an immediate threat to themselves or others, an emergency discharge may be implemented without prior notice.
✔ In such cases, family members or emergency contacts will be notified immediately, and arrangements for alternative care will be made.
C. Resident & Family Consultation
✔ Our team will work closely with the resident and their family to ensure a smooth transition to an alternative care facility or home.
✔ We will provide recommendations for continued care, including medical records and discharge documentation.
3. Appeals & Dispute Resolution
✔ If a resident or family member disagrees with the termination decision, they may submit a written appeal within 7 days of receiving the notice.
✔ The appeal will be reviewed by a senior administrative panel, and a decision will be made within 14 days.
✔ Mediation or legal consultation may be sought if necessary to resolve disputes fairly.
4. Responsibilities Upon Discharge
✔ Residents or their families must make necessary arrangements for transportation and relocation.
✔ Any outstanding fees must be settled before departure, unless alternative arrangements are agreed upon.
✔ The resident’s personal belongings must be collected within 7 days of discharge, unless storage arrangements are made.
5. Assistance with Relocation
✔ Our team will assist in coordinating with hospitals, rehabilitation centers, or assisted living facilities if required.
✔ We will provide medical records and care summaries to the next care provider for a seamless transition.
